TYPE: [Legislation] Freedom of Information Act (FOIA)
DESCRIPTION: Under the FOIA any person, including organizations, foreign citizens and associations, may request records maintained by a federal agency. However the same does not appply to records kept by Congress or the Judiciary. Some exceptions apply to records which "would clearly constitute a clearly unwarranted invasion of personal privacy and to records held by law enforcement that could "constitute an unwarranted invasion of personal privacy." When enacting this legislation Johnson stated, "I
have always believed that the freedom of information is so vital that only the national
security, not the desire of public officials or private citizens, should determine when it
must be restricted."
